SCOTUS-Care & SCOTUS-Pair -- Judicial Activism Run Amok


I woke up this morning to discover I was in a different country, one ruled by 9 unelected, black-robed ideologues every bit as tyrannical and ominous as the Imams of Iran.  They followed their radical ideologies to lay down the edict that same-sex marriage is the law of the land.  Judicial overreach and activism is running rampant.  Now we have 2 of the 3 branches of government rapidly expanding their powers, and the third timidly abrogating theirs at a time the others need some checks and balances.  The legislative branch needs to man-up & legally correct executive and judicial overreach.  Dodd-Frank was legislative social engineering overreach of the legislative branch that had similarly disastrous consequences – economic, causing the crash & recession we’re still emerging from.


Justices Scalia & Roberts wrote scathing dissents, criticizing the majority’s “hubris” to change several thousands of years of universal societal norm, their social engineering, legislating their will out of whole cloth rather than narrow legal interpretation based in the Constitution.  But Roberts’ indignation seems somewhat hypocritical and inconsistent.  After all, the ruling yesterday on Obamacare, for which he wrote the majority opinion, was exactly what he criticized today.  Another contortion of interpretation admittedly done to save the act, simply because the legislators intended for it to succeed – never mind how poorly it was written.  And that began with his earlier “tax” ruling on Obamacare. 

After starting the court down that path, which the Left-leaning justices were all-to-eager to follow, what does he expect, now?  Should he be shocked?  Just as when Bush started a spending spree, and Obama was all too glad to outdo him.  And of course while the conservative justices are sufficiently open-minded to now and then side with the liberals, the liberals absolutely never break ranks.  They’re fascist to the end.   And apparently the supposedly conservative chief justice is more concerned about the reputation of his court so as not to upset the Left politically, rather than just looking at the merits of what comes before him, and doing their job independently.  Maybe Obama’s statements a week or so ago did intimidate him.  Chicago-style politics.  And when our chief judges can be intimidated, we are in trouble.  Now apparently both the judicial and legislative branches, although nominally in the hands of conservatives, are frozen in fear of this emperor with no clothes.


And so we see again that elections have consequences.  Two Obama appointees made the difference, just as the fraudulent election of Al Franken was the single vote that put Obamacare over the top. 

SCOTUS (the Supreme Court of the United States) now seems to be in the same business as Webster’s dictionary – defining, or re-defining, our vocabulary.  The definition of a “tax” and “state” to save Obamacare, and of “marriage” to put a stake in the heart of DOMA (Defense of Marriage Act), which both Clintons & Obama had previously supported.  Oh, that’s right, that’s not a “flip-flop,” but “evolution.” 

As Scalia said yesterday, Obamacare might now more properly be called “SCOTUS-Care.”  And following in that vein, perhaps the marriage ruling could be called “SCOTUS-pair.”

So the court went beyond the Constitution and basically removed the states’ rights to decide for themselves.

It leaves some wondering, now that we’ve started down this path, where “equality” under the law is merely anyone’s ability to marry someone they love, if that includes polygamy, pedophilia, incest, etc.

How does this impact freedom of religion, and expression of beliefs regarding same-sex marriage, tax-exemption, etc.?

I truly fear for our nation now.  Ann Coulter’s new book title, “Adios, America!” http://www.renewamerica.com/columns/vernon/150627  seems appropriate.

My advice to someone depressed over this: Take 2 ounces of chocolate, and call me in the morning.

Someone pointed out that a few decades after Roe v. Wade we're still fighting the cultural war against abortion, and we'll likely need to do the same for marriage.
